By accessing and using www.cbre.pl ("Site") you confirm that you are a business user (i.e. you use this Site solely and only for business or professional purposes), over the age of 18 years and permitted to use this Site, and you agree to be bound by all of the following terms and conditions of use ("Terms"). The Site is intended for business or professional purposes only, therefore, these Terms do not apply to consumers.

These Terms govern your use and access to the Site except where there are separate terms and conditions relevant to particular areas of this Site, which are indicated on the appropriate Site page. If you do not agree to abide by these Terms then you should not use this Site. For clarity, in these Terms, references to “CBRE”, "we", "us", "our" and "ourselves" are references to CBRE sp. z o. o. 
 
These Terms together with Global Web Privacy and Cookie Notice ("Global Privacy Policy") available at https://www.cbre.pl/en/privacy-policy set out the basis on which we will collect, use and disclose certain personal data from you. Your use of this Site signifies your understanding and acceptance of these Terms.
 
You are bound by the Terms posted on this Site at the time of your use of the Site. We may from time to time modify these Terms and will post a copy of the amended Terms on this Site. We would advise you to periodically visit this Site and this web page to ensure that you are up to date with any changes that have been made. The content of these Terms is available and may be downloaded or copied free of charge. 

1. General remarks, scope of services,

These Terms fulfil the obligation referred to in Article 8(1)(1) of the Polish Act on Providing Services by Electronic Means of 18 July 2002. 
Matters not covered by these Terms shall be governed (to the extent possible) by the provisions of the Polish law, in particular Act on Providing Services by Electronic Means of 18 July 2002, provisions of the Polish Civil Code and other applicable laws. For the avoidance of doubt, none of the provisions of these Terms shall limit the rights of an entrepreneur to whom the provisions on consumer rights apply, to which he is entitled under the provisions of applicable law. Where such a provision exists, the provisions of applicable law shall apply unconditionally.

Services available on this Site include: enabling an Internet access to the Site where you can get access to all the information presented on the Site (e.g. general information regarding CBRE, information on locations of CBRE entities worldwide) and/or use contact forms to contact CBRE. Services are provided on a continuous basis, from the moment when you open this Site.

The agreement on the provision of services on this Site between you and CBRE sp. z o. o. is concluded on the moment when you access the Site, while the termination of the agreement for the provision of services occurs when you close this Site.

2. Intellectual Property

You acknowledge that CBRE owns or has a license to all title and copyright in and to the content provided on this Site. All title and intellectual property rights in and to any licensed content provided on this Site is the property of the respective content owners and may be protected by applicable copyright or other intellectual property laws and treaties and subject to use restrictions under such laws or treaties. 

You may use this Site for your information and internal business purposes (such as making decisions regarding cooperation with CBRE) and you may make a copy of the pages of this Site but only for your internal business use, and provided that you keep all copyright and other proprietary notices intact. Any modification, transmission, copying or use of the content of this Site for public or commercial purposes (other than internal business use) is prohibited. The following are registered trademarks or trademarks of CBRE: CBRE and its design logo, as well as certain other CBRE trademarks, service marks, graphics, and logos (collectively, the "CBRE trademarks") used in connection with CBRE's provision of products and services. 3. Restrictions

You agree that you will not: (i) use the Site to reproduce, transmit, display or distribute copyrighted material in any medium or via any method without CBRE's express written permission; (ii) copy, store, edit, change, prepare any derivative work of or alter in any way any of the content provided on this Site; or (iii) use our Site in any way that violates these Terms or generally applicable laws. 

You agree that you will not: (a) impersonate any person or entity or misrepresent your affiliation with any other person or entity; (b) engage in spamming, flooding, harvesting of e-mail addresses or other personal information, spidering, screen scraping, database scraping, or any other activity with the purpose of obtaining lists of users or any other information, including specifically, property listings available through the Site; (c) send chain letters or pyramid schemes via the Site; (d) attempt to gain unauthorized access to other computer systems through the Site; or (e) use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site; (f) provide false, inaccurate, outdated or incomplete personal data regarding you or any other person. 

4. Global Privacy Policy and Submission of Information

Unless otherwise addressed in these Terms, your use of this Site is subject to Global Privacy Policy. Other than personally identifiable information (i.e. personal data), which is covered under our Global Privacy Policy, any material you transmit or post to the Site shall be considered non-confidential and non-proprietary. CBRE shall have no obligations with respect to such material. Any communications and other material which you transmit or post to this Site is and shall remain as our property and by sending the same you agree that we may use the same for any purpose whatsoever, without any compensation being payable by us to you.

CBRE sp. z o. o. is a data controller of personal data processed through the Site to the extent where Global Privacy Policy provides that a local CBRE entity is responsible for processing personal data through local CBRE sites.

5. Disclaimer

To the maximum extent permitted by law, CBRE excludes all warranties, either express or implied (including, but not limited to, implied warranties of satisfactory quality, fitness for purpose and the use of reasonable care and skill). CBRE makes no representations, warranties or guarantees that this Site will be free from corruption, attack, viruses, interference, hacking, or other security intrusion. 

CBRE does not guarantee the continuous and uninterrupted availability of the Site or its particular pages or contact forms. CBRE reserve the right to interrupt the availability of the Site (or its parts), without notice, in particular when this is caused by the need to repair, expand, modify or maintain hardware or software or due to the reasons beyond CBRE’s control (in particular: force majeure, acts or omissions of third parties). CBRE has the right to discontinue the Site at any time if such a justified request is made by the Internet provider or other authorized entity. To the extent possible under the applicable law, CBRE is not liable for damages caused by the malfunction of the transmission system, including equipment failures, delays and disruptions in the transmission of information.

Whilst we have worked diligently to provide accurate and complete information, this Site is provided free of charge to you and, to the maximum extent permitted by law, we cannot be liable to any person for any loss or damage which may arise directly or indirectly from the use of this Site (or any inability to use it) or any of the information contained on this Site. All property listing information on this Site is subject to the possibility of errors, omissions, change of price, rental or other conditions, prior sale, lease or financing, or withdrawal without notice. Any projections, opinions, assumptions or estimates contained within this Site are for example only, and may not represent current or future performance of a listed property. None of the information on this Site, in particular property listings, shall constitute an offer within the meaning of Article 66(1) of the Polish Civil Code. 6. Liability

To the maximum extent permitted by law, in no event will CBRE be liable to you for damages (including, without limitation, damages for loss of profits, business interruption, corruption of files, loss of business information or any other pecuniary loss) in connection with the Site in any way or in connection with the use, inability to use or the results of use of the Site. Nothing in these Terms limits CBRE's liability for death or personal injury. No oral or written information or advice given by CBRE or others will create a warranty and neither you nor any third party may rely on any such information or advice. 

7. Indemnity

To the maximum extent permitted by law, you will indemnify and keep indemnified CBRE against all losses, costs claims, demands or expenses (whether direct or indirect) arising out of (i) any claim that your operation, possession or use of the Site or any part of it is in contradiction of these Terms in any way or any materials or information you submit to us infringes the copyright or intellectual property rights of any third party or data subjects’ rights related to the protection of personal data; or (ii) your use or misuse of the Site. 

8. General

You agree that you will comply with all relevant laws applicable to your use of this Site. 

CBRE or its business partners may present advertisements or promotional materials on or through the Site. Your dealings with, or participation in promotions of, any third-party advertisers on or through the Site are solely between you and such third party and your participation is subject to the terms and conditions associated with that advertisement or promotion. CBRE is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third party materials on the Site. 

Links on this Site and other websites that we operate may lead to third party websites. The content, accuracy and function of such websites is outside of CBRE’s control and we cannot accept any responsibility for those websites, nor do we endorse the content of such third party websites. In particular, any dealings that you have with such third party website operators shall be on the terms and conditions (if any) of that website operator.

If any provision of these Terms is held by a court to be illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

Failure by us to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. 

These Terms set out the entire agreement and understanding between the parties in connection with the use of this Site and shall supersede and replace all other terms and conditions purported to be applied. 

These Terms are governed by Polish law and, to the maximum extent permitted by law, you agree to submit to the exclusive jurisdiction of the Polish courts.  

9. Technical requirements and risk connected with the use of the Site

You are able to access and use the Site through devices with an Internet connection, in particular computers, smartphones and tablets. It is necessary that the devices have access to a commonly used, properly configured web browser in the most up-to-date version, with JavaScript support and acceptance of cookies.
Using a content-blocking software (e.g. AdBlock) might disrupt or prevent the use of the Site. The use of viruses, bots, worms or other computer code, files or programs, including automated scripts and applications and other potentially disruptive tools is prohibited on the Site.
The following risk are connected with the use of Internet, including this Site:
- the risk of receiving unsolicited commercial communications by electronic means (spam);
- the risk of malicious or harmful software (e.g. viruses, worms or “Trojan horses”);
- the risk of breaking the security measures for the purpose of obtaining personal data, including for the purpose of identity theft, by sending fake electronic messages resembling genuine messages;
- the risk of phishing in order to obtain your personal data or confidential information;
- the risk of a breach or bypass of the encryption system and consequently the possibility of obtaining your personal data or confidential information;
- the risk of the use of spyware - a computer program designed to intercept and possibly analyse data flowing through the network.
To avoid these risks you should install an antivirus and a firewall on your devices that are connected to the Internet. Such programs should be constantly updated.

The notification or complaints should contain a detailed description of the problem that occurred (including the date and time or the period, if applicable, of its occurrence) and your contact details so we are able to provide a response. We may ask you to provide additional information, if it is necessary to provide a response. We will respond to your request or complaint within 30 days of receiving all the information.
